I Love Ugly x Keith Haring Giveaway

Terms and Conditions

These Terms and Conditions relate to the smart Giveaway (the “Prize Draw”) promoted by smart Automobile NZ Ltd of 61 Mountain Road, Mt Wellington (“Promoter”) and are effective as of the Prize Draw start date.

1. Eligibility
1.1 This Prize Draw is open to individuals residing in New Zealand.
1.2 To be eligible to win the prize, entrants must be 18 years or over.
1.3 Employees of the Promoter or any associated company and their immediate family, as well as any individuals involved in the organisation of the Prize Draw, are not eligible to enter.
1.4 Entrants will require access to the internet to participate.
1.5 Entrants must have their own active personal Instagram (or Facebook) account.

2. How to Enter
2.1 Participants can enter the Prize Draw by:

• Following @smart_newzealand on Instagram or @smart New Zealand Facebook;
  • Liking the official giveaway post
  • Tagging a friend in the comments (each tag counts as one entry)
  Bonus entries: Reposting the smart x Keith Haring video on Instagram Story or Facebook, with your own caption, will count as two (2) additional entries

2.2 Entries must be received between 12 September 2025 and 28 September 2025 (“Prize Draw Period”).
2.3 Entries received after the Prize Draw Period will not be valid.
2.4 No bulk, third party or automated entries will be accepted.
2.5 Entrants must comply with any reasonable directions provided by the Promoter in relation to the Prize Draw.

3. Winner Selection and Contact
3.1 Three (3) winners will be selected at random by the smart New Zealand team.
3.2 The Promoter’s decision is final and no correspondence will be entered into.
3.3 Winners will be contacted via direct message on Instagram (or Facebook if entered via repost) within five (5) days of the Prize Draw ending.
3.4 Winners must respond within 48 hours of being contacted to confirm their prize, otherwise the prize may be reallocated to another randomly selected participant.
3.5 The Promoter reserves the right to contact a new winner if the original winner fails to respond or does not meet eligibility requirements.

4. Prize
4.1 Three (3) winners will each receive a $200 I Love Ugly voucher.
4.2 The Prize is non-transferable, non-refundable, and cannot be exchanged for cash or any other alternatives.
4.3 Prize delivery (voucher codes or physical vouchers) will be arranged after confirmation with each winner.
4.4 If a winner is unable to accept the prize for any reason, the prize will be forfeited.

5. Winner Publicity
5.1 The Promoter reserves the right to publish the winner’s name on official smart New Zealand social media channels.
5.2 By entering the Prize Draw, winners agree to participate in any publicity related to the promotion, including photography or interviews, without further compensation.

6. Entry Content
6.1 Any entry deemed offensive, unlawful, or inappropriate by the Promoter will be excluded.
6.2 The Promoter reserves the right to take further action if necessary and will cooperate with relevant authorities if content violates laws.

7. Use of Entries and Data
7.1 By entering the Prize Draw, participants grant the Promoter the right to use their entry content for promotional purposes across various platforms and media.
7.2 By entering, you acknowledge that smart Automobile NZ Ltd may collect personal information to manage the giveaway and contact winners.

8. Limitation of Liability
8.1 The Promoter will not be liable for:
• Entries lost, delayed, misdirected or not received
• Any technical malfunctions or failures
• Any costs, damages or losses incurred by entrants related to participation in the Prize Draw or use of the prize

8.2 Nothing in these terms limits statutory rights or excludes liability for fraud or personal injury caused by negligence.

9. General
9.1 The Promoter reserves the right to cancel, modify, or suspend the Prize Draw at any time.
9.2 This promotion is not sponsored, endorsed, or administered by Instagram or Facebook. Entrants fully release these platforms from any liability.
9.3 These Terms and Conditions are governed by the laws of New Zealand.
